With the recent FAR Overhaul, Part 9 has been completely revamped—streamlined to remove redundancies while retaining key accountability measures. Here’s what has changed, why it matters, and how you can stay ahead.
What’s Changed from the Old Part 9?
1. FAPIIS Is Mandatory—Upfront Under the old Part 9, reviewing your past performance or integrity (through FAPIIS) was expected but not always enforced thoroughly. Now, agencies must review FAPIIS for solicitations above the simplified acquisition threshold—and document how that review influenced the award decision.
Why it matters: Contractors with clean records may now see an advantage, while those with issues can’t slip through unchecked.
2. Responsibility Clauses Simplified Key clauses—like 52.209-5 (Certification Regarding Responsibility Matters) and 52.209-7 (Information Regarding Responsibility Matters)—remain, but have been stripped down to their essentials. It’s now clear when each applies: one for unlimited solicitations, the other specifically for acquisitions above $600K.
Benefit: Less confusion about triggers and less unnecessary documentation.
3. Qualification Rules Made Visible Previously, qualification requirements—like QPL, QML, or First Article Testing—weren’t always clearly published. Now, if an item requires qualification, agencies must post that notice publicly. If you haven’t heard about it, you can’t respond in time—and that’s on the agency.
Impact: Contractors get fair warning and equal opportunity to qualify.
4. First Article Testing Is Sharply Scoped Under the updated rules, first article testing (via clauses like 52.209-3 or 52.209-4) is required only when justified—and waivers must be clearly stated.
Contractor gain: Less last-minute testing drama and more predictable requirements upfront.
5. Debarment & Suspension Language Clarified The rules around exclusion from federal contracting remain, but the language is tighter. Agencies have clearer guidance on causes, procedures, and contractors’ rights.
Value: Increased fairness and clarity for ethical businesses.
6. Conflict-of-Interest Rules Streamlined Organizational conflicts of interest (OCI) provisions are now clearer and easier to navigate, making it less likely that unrelated internal guidance trips you up.
Responsibility Is Non-Negotiable Agencies now look first at responsibility. If your FAPIIS record is clean, you’ll likely get priority in evaluation. If not, there’s limited ability to impulsively explain issues—transparency is key.
Small or New Contractors Can Compete More Fairly With qualification processes transparent and standardized, even smaller firms can step in. This levels the ground for firms outside the usual QPLs.
Clarity Reduces Risk Less ambiguity means fewer surprises. When rules are consistent and visible, you can prepare more confidently—but if you’re fuzzy, you risk missteps.
Protection, Not Punishment The revised debarment and OCI rules allow agencies to act when real harm or unfair advantage exists, and gives contractors a fair process in return.
Audit Your FAPIIS and SAM Profile Start by ensuring your FAPIIS entry is accurate and your SAM profile is up to date. If there’s a past issue, document your corrective actions—even proactively.
Watch for Qualification Notices Actively scan SAM.gov and FedBiz365, especially for products that might have special qualification requirements—then engage early.
Maintain PMT Readiness Invest in documentation that supports your reliability, like test data, certificate records, or existing GSA Schedule performance.
Internal Integrity Check Periodically assess your firm’s internal processes for OCI or similar conflicts. Prevent problems before they become disqualifying conditions.

Let me tell you — government paperwork is no joke. I went into this SDVOSB certification process fully expecting to lose at least 3 brain cells and my will to live somewhere between page 47 and form 18B. Then came Ashley. Like an angel with a headset, she swooped in and somehow made sense of it all. I swear, this woman could turn a mountain of government forms into a walk in the park.
She’s fast, sharp, and somehow manages to make federal forms almost fun (that’s saying something). Ashley deserves a medal — or at least an unlimited coffee subscription.
