The regulatory changes are intended to improve coordination between the VA’s “Vets First” program, which covers (SD)VOSB set-asides issued by the VA and the SBA’s program, which covers (SD)VOSB set-asides issued by all other government agencies.
The primary feature of the new regulations is a unified definition of ownership and control. Going forward, the SBA will be solely responsible for defining ownership and control as well as for adjudicating any challenges to a (SD)VOSB’s status that are based upon issues of ownership and control. The VA will continue to verify that contractors meet the definition of (SD)VOSB for purposes of the Vets First program, but it will use the SBA’s definition of ownership and control when doing so.
