CONSENT TO RECEIVE ELECTRONIC RECORDS
By participating in the products or services on the site, User signifies User’s express consent to receive information from Company in electronic format. User will need a computer with browser and Internet access to receive such electronic records. Electronic records may include terms and conditions, agreements, privacy policies, and other items.
LICENSE TO USE THIS SITE
Upon User’s accepted Sales Order by the Company, User acknowledges and agrees that the Company hereby grants User a non-exclusive, non-transferable limited license to use this site in strict accordance with the terms and conditions outlined herein and as permitted via instructions on this site. User agrees not to make any false or fraudulent statements in User’s use of or to gain access to this site. User acknowledges and agrees that all content and services available on this site are property of the Company and its advertisers and licensors and are protected by copyrights, moral rights, trademarks, service marks, patents, trade secrets, and other proprietary rights and laws, in the U. S. and internationally. All rights not expressly granted herein are fully reserved by the Company, its advertisers and licensors. User agrees to pay for any and all purchases and services made using your name and credit card through this Site, not to challenge any such charges and to pay for all collections and/or attorney’s fees resulting from any non-payment.
LICENSE RESTRICTIONS USE
User agrees not to make any false or fraudulent statements in User’s use of or to gain access to this site or during User’s use of this site. Except as may be explicitly permitted through this site, User agrees not to save, download, cut and paste, sell, license, rent, lease, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from materials, code or content on or from this site or that is property of Company or any advertiser offering materials through our programs. Systematic retrieval of data or other content from this site or the site of any party offering materials through this site to create or compile directly or indirectly, a collection, compilation, database or directory without written permission from the Company is prohibited. In addition, use of the content or materials for any purpose not expressly permitted herein is strictly prohibited.
FEDBIZ ACCESS TERMS AND CONDITIONS
GENERAL
GSA Access Group, LLC (a/k/a FedBiz Access) is also referred to herein as the Company. User agrees to honor any and all Terms and Conditions applicable to their Sales Order and interaction with Company.
Company offers various Products, Services, and Subscription Packages intended to assist User in marketing their entity to interested local, state, or federal government contracting resources. Company is not a government agency and is not affiliated with the government. Company is a private, third-party business development firm for government contracting registration and consulting services. Company does not render tax, legal and/or accounting advice and none of Company’s services should be relied on for such purposes. The government offers free registration forms at SAM.gov and SBA.gov. Fees paid to the Company are for services as described on the Company’s website and marketing materials. Any and all payments accepted, constitute and confirm acceptance of the terms, conditions and policies hereof.
The products, services, and/or subscription packages purchased by User constitute the Sales Order agreement between User and Company.
Depending on the combination of products, services, or subscription packages that constitute the User’s Sales Order agreement with the Company, the specific terms and conditions outlined for “Products and Services”,, and “Subscription Packages” will be recognized by both User and Company as applicable to User’s Sales Order agreement.
“Products” are defined as any solution provided by Company in exchange for a fixed price that results in a deliverable “good” (report, document, etc.) to the User.
“Services” are defined as any solution provided by Company in exchange for a fixed price that results in delivery by Company to User of information, data or strategy in a format other than those defined as Products.
“Subscription Packages” are defined as any service billed as a cyclical recurring charge by the Company to a User in exchange for ongoing proprietary access to information, databases, or some other valuable commodity owned or managed by Company.
The FedBiz Access® name and logo as well as the GRL® and Government Readiness Level® marks are the Company’s Registered trademarks.
PRODUCTS AND SERVICES
If a User’s Sales Order with Company includes one or more Product or Services, the following terms and conditions are applicable:
Company is responsible for delivering stated Product and/or Service in a reasonable format and timeframe, based on the product/service description and as outlined in the corresponding Sales Order.
User is responsible for reading, agreeing to and abiding by the Product/Service Sales Order prior to the Company beginning any work for fulfillment.
User will be asked to pay additional fees for support / continued engagement beyond the scope of the standard deliverable(s) and timeframe(s) if any, of the Sales Order.
Fees on product / service rendered do not include any third party registration or related fees; any such fees, as may be applicable, will be disclosed by the Company, and will be paid by the User directly to any such third party provider; similarly, any refund or cancellation requests for such fees will need to be addressed by the User to such third party provider.
SUBSCRIPTION PACKAGE / MEMBERSHIP
If a User’s Sales Order with Company includes one or more Subscription Packages, the following terms and conditions are applicable:
User is responsible for continued utilization of the Company’s government contracting database and/or marketing tools provided. User is responsible for engaging their Company representative if they have questions about database and/or marketing tools utilization.
User understands and agrees that monthly recurring subscriptions that are upgraded to, or prepaid by the User on an annual basis, as may be applicable, may render User a “Member” of the Company’s Products/Services, and as such, Member may periodically receive other discounts and offers otherwise not available to User. Membership-based subscriptions are subject to auto renewal.
Subscription and/or Membership fees are earned upon payment with no pro-rated refunds at the time of cancellation.
CANCELLATION / REFUND POLICY
PRODUCTS AND SERVICES
Cancellation notices from User to Company can only be accepted in writing via email to cancellation@fedbizaccess.com. The email must include the name of the business, business phone number, and the word CANCEL in the body of the email. Receipt of cancellation request does not change any of the agreed upon terms of the Order and does not otherwise qualify User for any refund, exchange or credit. Cancellation orders will trigger a customer service call by the Company to the User to further address any concerns as pertaining to the User’s corresponding Sales Order.
By purchasing any product, service or subscription package, User acknowledges that User has read, understood and agreed to be bound by the following terms and conditions: a) No refund policy for final Sales Order(s); all sales of products, services or subscription packages are final; b) The User acknowledges that they are making their purchase decision based on the product or service descriptions as provided by the Company’s website and that they have had ample opportunity to address any queries or concerns prior to the finalization of their purchase. User agrees to bear all responsibility for ensuring the correctness of their purchase prior to final confirmation. User is responsible for understanding the full scope, functionality, and limitations of any product or service purchased through the Company. User agrees to utilize the support channels provided by the Company for any clarifications or issues related to their purchase but acknowledges that this does not imply any guarantee or expectation of a refund, credit or exchange; c) At the sole option and discretion of the Company, a Services or Reinstatement Credit may be calculated subject to limitations including instance of work that has been ongoing, or bears an Admin Hold notation due to User deliverable issues. The Company reserves the right to extend any Services or Reinstatement Credit to User, at the time of re-engagement, for the same or different service, taking into account any previously extended offers, member or discounted pricing, or other financial incentive previously extended to User. Services or Reinstatement Credit is only valid up to one year from the initial date of purchase; d) Completion of services as submitted to any third-party government site and/or to the customer directly, accompanied by notice of such completion/submission, constitutes satisfactory acceptance by the User, unless such acceptance is denied or disputed within twenty-four (24) hours of such submission/notice. The User agrees not to stop payment on any types of payment including but not limited to Credit Cards, Checks, ACH, or Check Drafts. Any charges of a stop payment or dispute to any bank or payment processor will be in direct violation of this agreement and all charges associated with this action will be passed on to the User, not limited to attorney fees and bank charges. By acceptance of this agreement, User is bound to all its Terms and Conditions.
SUBSCRIPTION PACKAGE
If User wishes to cancel any Company Subscription License, User must submit a written request to cancellation@fedbizaccess.com and in order to expedite the cancellation process call our Customer Service number 888-801-8495. User will be required to speak to a member of our Client Services Team to facilitate User’s cancellation request. Once confirmed by a Client Services Specialist, User will receive a cancellation confirmation communication via email, completing the cancellation process. Cancellation requests may only be submitted by the authorized billing contact on User’s subscription/account.
Due to proprietary information, there are no refunds for subscription package orders. Cancellation requests can be requested at any time prior to User’s next recurring billing charge, but no later than 5 business days prior to the date of User’s account next billing cycle in order to prevent unauthorized billing. Cancellation requests cannot be applied retroactively, nor can result in any refund or credit for previous recurring monthly usage/access/cancellation request not compliant with the cancellation request procedure herein.
User’s Subscription includes a Set-Up / License Fee. This license fee allows the user to access Company’s proprietary government contracting database and marketing tools. Accessing the Company’s proprietary government contracting database and/or marketing tools, activates User’s License. Once User’s license is activated, User is no longer eligible to a refund of fees paid for User’s license to Company’s proprietary database and/or marketing tools.
Once User has received access to the proprietary data contained within the Company’s database, the User has the ability to download, copy, or otherwise leverage the data provided. Therefore, any fees (including account set-up fees) paid to the Company that result in User receiving access to the Company’s database are non-refundable.
Furthermore, User understands and agrees that monthly recurring subscriptions that are upgraded to, or are prepaid by the User on an annual basis, as may be applicable, render User a “Member” of the Company’s Products/Services, and as such, Member receives substantial discounts and special services, OTHERWISE NOT AVAILABLE to User. Such Member-based subscriptions are subject to auto renewal on the same terms and conditions. Membership-based, recurring annual subscriptions are twelve (12) consecutive month contractual obligations that are not subject to pause or cancellation prior to the annual anniversary renewal date.
Subscription and/or Membership fees are earned upon payment with no pro-rated refunds at the time of cancellation.
The subscription period for the Annual Subscription Plan will be for one year and will automatically renew (without the needs to go through a “checkout” or execute a renewal order form) for additional periods equal to one (1) year, each year on the anniversary unless cancellation is received at least five (5) business days prior to the renewal date. Billing will occur on or about the same date each year until the time of cancellation. Note that under the Annual Subscription plan User will not be permitted to cancel, reduce the number of Seats/Licenses, or downgrade the Subscription Service User has selected until the anniversary date. User acknowledges and agrees that User is committing to a one-year plan; if User is not certain, Company recommends choosing the Monthly Subscription Plan.
Written notification of cancellation must include customer name, company name, CAGE Code, address, and telephone number, and the effective date of termination of the subscription/account. Completion of the cancellation process will result with a cancellation email containing a confirmation code. Subscriptions/accounts that are not terminated in accordance with the above procedures shall remain active and shall continue to incur periodic service charges until properly terminated.
To ensure that User’s payment method will not be charged for User’s next billing period, it is User’s responsibility to make sure the cancellation policy is followed and confirmation has been received via email to complete the process.
If a dispute does result prior to cancellation being received by the Company then User will be responsible to incur any costs incurred by both parties until the proper cancellation process has been followed.
User agrees to ensure that User’s payment method details are kept up to date. If Company is unable to process payment from the payment method on file, Company regrets that it will be necessary to suspend User’s access to the subscription sections of the Paid For services until User provides Company with details of a valid payment method. User can do this by calling Company’s customer service department at 877-376-4249. User will still be liable for any outstanding payments that could not be met when User’s account was suspended.
MODIFICATION TO TERMS
The Company reserves the right to modify these terms at any time. It is the User’s responsibility to periodically review these terms to stay informed of any updates. Continued use of the Company’s products services or subscriptions after modifications signifies the User’s agreement to the new terms. By checking the “I Agree” box, and/or submitting payment on the Sales order online, via phone, email or mail, the User affirms that they have read, understood, and accepted the above terms in their entirety. The User also affirms their understanding that their purchase is final, as per the terms herein.
